1. Acceptance of Terms
By accessing or using EncounterCraft ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. The Service is operated by EncounterCraft, based in the Netherlands.
2. Description of Service
EncounterCraft is a web application that provides AI-assisted tools for creating Dungeons & Dragons encounters, generating NPC descriptions, and producing AI-generated character artwork. The Service is available in a free tier (Seeker) and a paid tier (Master) at $9.99 per month.
3. User Accounts
You must sign in via Discord or Google OAuth to use the Service. You are responsible for maintaining the security of your account. You may not share your account with others or use it for commercial redistribution of generated content without permission.
We reserve the right to suspend or terminate accounts that violate these terms or engage in abusive behaviour toward the Service or other users.
4. Subscriptions and Payments
The Master plan is billed at $9.99 per month. Payments are processed securely by Stripe. Your subscription will automatically renew each month unless cancelled.
You may cancel your subscription at any time through the billing portal. Upon cancellation, you retain access to Master features until the end of your current billing period. No refunds are issued for partial months.
We reserve the right to change pricing with 30 days' notice to existing subscribers.
5. Usage Limits
Both tiers have monthly usage limits for encounter generation, image generation, and ability creation. These limits reset at the start of each calendar month. Unused allowances do not carry over. We reserve the right to adjust limits with reasonable notice.
6. AI-Generated Content
The Service uses OpenAI's GPT-4 and DALL-E 3 models to generate content. You acknowledge that:
- AI-generated content may occasionally be inaccurate, incomplete, or unexpected
- Generated images are subject to OpenAI's usage policies
- You are responsible for how you use generated content at your gaming table
- We do not guarantee the accuracy or suitability of any generated content
7. Intellectual Property
Encounter data and content you create using the Service remains yours. We do not claim ownership over your encounters or the text you input. Generated images are subject to OpenAI's content policy. The EncounterCraft application, branding, and code remain the property of EncounterCraft.
8. Prohibited Use
You may not use the Service to:
- Generate harmful, illegal, or offensive content
- Attempt to circumvent usage limits or access controls
- Scrape, copy, or resell the Service or its outputs at scale
- Reverse engineer or interfere with the Service's infrastructure
9. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted availability. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
10. Governing Law
These Terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
11. Changes to Terms
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. For material changes, we will make reasonable efforts to notify users.
